Terms of use
Introduction: These Terms of Use of Limousine and Car Service (“Service Terms”) are a legal and binding agreement between you and 305VIP / Whal Transportation INC governing your use of the services offered. Please review these service terms fully before using our services. By using the services, you agree to be bound by these Service Terms.
Acceptance of Terms: By using the services and website of 305VIP / Whal Transportation INC, you agree to be bound by these terms of use, as well as our privacy policy and any other policies or agreements that may be applicable.
Rate Estimate: The rate quoted prior to your trip is an estimate based on the information provided at the time of the reservation. The actual total amount due will be calculated upon completion of the trip. Waiting time, after-hour fees, airport fees, and additional stops are not included in the estimate and may be charged at any time.
Additional Charges:
- Private Greeter: Available upon request with an additional charge between $25 and $100, depending on the airport. It must be requested 24 hours prior to the service time.
- After-Hour Trips: Trips between 12:00 am and 6:00 am will have an additional charge of 20% of the base rate.
- Holiday Services: Services provided on New Year’s Eve & Day, Christmas Eve & Day, and Thanksgiving Day will incur an additional charge of 20% of the base rate.
Wait Time:
- Domestic Airport Arrivals: 45 minutes grace period after landing time.
- International Flights: 1-hour grace period after landing time.
- FBO Arrivals: 30 minutes grace period after landing time.
If the customer does not communicate with the driver or customer care, it will be considered a NO SHOW. If the customer requests extra time, the hourly charge will apply in fractions of 30 minutes.
Additional Stops: Any stops made during your trip will incur an additional charge based on the type of vehicle. The stop fee covers up to 30 minutes. If this time is exceeded, an hourly rate will automatically apply. For precise information on charges and rates, please consult with our reservation office, as they may vary by city.
Delays and Traffic: While we make every effort to provide timely service, delays may occur due to traffic conditions, weather, or unforeseen events. We continuously monitor your flight, and in the event of a delay, we will attempt to accommodate you based on the availability of drivers and vehicles. If we are unable to accommodate the delay, it will be considered a no-show. We are not responsible for any missed flights, appointments, or other commitments resulting from delays. We recommend allowing extra time for your journey to account for potential delays, especially during peak travel times.
Late Cancellation & No-Show Policy:
- Sedans & SUVs: Cancellations within 24 hours of your scheduled pick-up time are billed at the full rate as quoted. Modifications within 2 hours of the original scheduled pick-up time may be subject to wait-time charges.
- Sprinter Vans, Mini Buses & MCI’s: Cancellations within 90 days of your scheduled pick-up time are subject to the full service charge as quoted.
By The Hour Reservation Deposits & Cancellations: Deposit amounts are determined by the vehicle hourly rate. All deposits are billed at the 3-hour minimum rate. Cancellations within 90 days of the service date are subject to the full deposit amount charge. No refunds apply.
Airport Arrival Protocol: Chauffeurs will meet passengers inside the baggage claim area for domestic flights or outside of customs for international flights unless otherwise required. If not specified, the pick-up will be curbside. Chauffeurs will hold a sign (iPad) with the passenger’s name. We monitor all flights and arrive at the airport when necessary. A grace period is given on all inbound flights after which the appropriate waiting time will be charged. Lost luggage, diverted flights, lack of gate, and slow luggage arrival may induce waiting time charges. Chauffeurs are not allowed to assist with luggage inside airport terminals due to union laws and protocols, but once outside the terminal, our chauffeurs will gladly assist with luggage. Porter service is available at the client’s expense.

Cancellations: Cancellations are accepted via email if sent to info@305vip.com. Local weather and traffic conditions may not allow on-time pickups in all service areas; 305VIP / Whal Transportation INC shall not be held responsible for adverse or abnormal conditions. To preserve the safety of our chauffeurs and passengers, 305VIP / Whal Transportation INC has the right to cancel any scheduled service due to severe weather and/or unsafe conditions. We are not responsible for, and do not discount, any trip due to flat tires and/or any unforeseen mechanical and/or accident conditions. We do our best every day to provide the best possible experience when using our service.
For all event reservations that are canceled with 15 days’ notice, there will be no charge; otherwise, the full reservation fee will be charged. For special events like Art Basel, Fashion Week, and special awards, the free cancellation period is 45 days. After any cancellation, the client will receive a notification by email or text to confirm the cancellation notice.
Changes & Modifications: 305VIP / Whal Transportation INC requires that all changes be received by text or email at least 2 hours prior to pick-up. If a change made less than 2 hours prior to pick-up cannot be accommodated, the resulting cancellation may cause a full or partial charge to the customer. Itinerary change requests with 24 hours’ notice will be considered a no-show. However, we will make every effort to assist and find a suitable solution before categorizing it as such. You may cancel or modify your reservation within the specified timeframes outlined in your booking confirmation. Cancellation fees may apply, especially if the cancellation occurs close to the scheduled service time. The specific fees and timeframes will be detailed in your confirmation email. We understand that plans can change, and we aim to be as flexible as possible. However, to ensure fairness and operational efficiency, we have implemented these policies. Additionally, we may cancel your reservation due to unforeseen circumstances, including but not limited to vehicle unavailability or safety concerns. In such cases, we will notify you as soon as possible and offer alternatives or a full refund.
Child Safety Seats: Child safety seats are provided at the discretion of the company and based on availability at the time of request. Service charges may apply, and pricing details can be found on our website www.305vip.com or by calling our offices. 305VIP / Whal Transportation INC assumes no responsibility for any injury or damages suffered by the user. Therefore, the child safety seat must be installed by the client only. Chauffeurs are neither authorized nor certified to install this device. If children are not declared in the booking form and this policy is violated, the driver has the right to refuse the trip, which will be considered a no-show, and 100% of the fare will be charged.
Flight Information Policy: It is the client’s responsibility to provide accurate flight information, including airline, flight number, FBO, and tail number, at the time of booking. Failure to provide this information at the time of booking absolves 305VIP / Whal Transportation INC of any responsibility for delays in pickup.
Lost & Found Property: 305VIP / Whal Transportation INC, or its chauffeurs, are not responsible for lost or stolen items. In the event that lost items are found, 305VIP / Whal Transportation INC will attempt to return the item(s) in a timely manner at the owner’s expense.
Vehicle Clean-Up Fee: All vehicles requiring excessive cleaning due to vomit, mud, sand, pet hair, or odors will incur the following charges: $500.00 for Sedans and SUVs, $750.00 for Sprinter Vans and Limousines, and $1,000.00 or more for all other vehicles, depending on the severity. Additionally, all of our vehicles are strictly non-smoking. The client agrees that there will be no smoking in our vehicle(s). If smoking does occur, the driver has the right to cancel the trip, resulting in a charge of 100% of the fare plus the cleaning fee, with a minimum cleaning fee of $1,000.00.
Damage Fee: If any items are missing from inside the vehicle (such as chargers, diffusers, filters, or empty coolers), there is a minimum replacement fee of $100.00. If the passenger causes any damage to the vehicle, either inside or outside, the passenger or booker will be responsible for all repair costs, which will be billed against the final repair invoice. It is illegal to stand through the sunroof. Final charges for the trip are determined upon ride completion.
Other Policies: 305VIP / Whal Transportation INC strongly recommends the use of seat belts while the vehicle is in motion. The client agrees that no illegal drugs will be consumed in our vehicle(s) and that the passenger capacity of any vehicle provided shall not exceed the number of seat belts available. In case of misconduct or drug use by the client or their party, or if the driver feels threatened, the chauffeur has the right to terminate the service and this agreement without any refunds, and drop all passengers off at the nearest safe location; full charges will apply. The client holds 305VIP / Whal Transportation INC harmless and not liable for any personal or material damages arising from the conduct of the client and/or their party.
